Selling at a green market in Republika Srpska: who may sell and what you need

Published: 6 October 2026Updated: 8 October 2026Author: AgroTour Connect team
In brief

Registered traders may sell at a green market, and so may farms and individual farmers without registering a business, but only their own produce. Selling your own products at a market stall does not require a fiscal receipt from an electronic fiscal device.

This article explains who may sell at a green market in Republika Srpska, which documents you need to carry with your goods, and when a fiscal receipt is required. It concerns small producers, farms and traders selling at markets in Trebinje, Bileća, Gacko, Ljubinje, Nevesinje and elsewhere.

In short

  • At a retail market, including a green market (zelena pijaca), registered traders may sell. So may individuals engaged in farming and farms registered under the farm registration rules, without registering a business (Law on Trade, Article 81, paragraph 1).
  • Individuals without registration may sell only fruit, vegetables and other agricultural products they produced on their own farm (Article 81, paragraph 2).
  • Selling your own products from market stalls is exempt from recording sales on an electronic fiscal device (Regulation, Službeni glasnik RS nos. 10/24, 6/25, 68/25 and 87/25, Article 2, point 6). The same point also covers selling agricultural products from your own family farm in the farm's production premises, and selling your own products at stalls outside markets and in open spaces. Since 13 August 2025 (Službeni glasnik RS no. 68/25) the exemption is no longer limited to sales directly to the final consumer.
  • The duty to keep a trade book does not apply to farms and individual producers under Article 81 (Article 97, paragraph 8).
  • Rules for a specific market (types of goods, display, upkeep of premises and equipment) are set by the market rules, adopted by the trader that operates the market (Article 82).

Who it applies to

  • Farmers and farms selling their own produce: fruit, vegetables and other agricultural products from their own holding.
  • Registered traders and entrepreneurs selling goods at a market, including goods bought for resale.
  • The law separates the green market from the goods market, the kvantaši (kvantaška) market, the second-hand market and the car market (Article 80, paragraph 2). Only the green market is covered here.

What to do

  1. Check that you are entered in the register of agricultural holdings. This is the condition for a farm to sell without trader registration (Article 81, paragraph 1). Registration is done by APIF (Agencija za posredničke, informatičke i finansijske usluge, the Agency for Intermediary, IT and Financial Services) at its unit for the holder's place of residence; for East Herzegovina this is PJ Trebinje, tel. 059/224-955.
  2. Sell only what you produced yourself. Bought goods may not be resold without a registered trade activity.
  3. Article 81 covers fruit, vegetables and other agricultural products from your own holding. If you sell processed food (cheese, meat, processed honey, rakija), check the hygiene and veterinary requirements with the Republička uprava za inspekcijske poslove (Republic Inspection Administration) before selling.
  4. If you are a registered trader, carry reliable documents (invoice, dispatch note, delivery note, purchase receipt or similar) showing the origin, quantity and type of the goods (Article 95, paragraph 2). A retail trader may not sell goods without proof of purchase and must keep a trade book (Article 97).
  5. A registered trader issues a fiscal receipt or another appropriate receipt for each sale under the fiscalisation rules (Article 95, paragraph 4). If you also carry out an activity that is not exempt, that turnover must be recorded on an electronic fiscal device (Law on Fiscalisation, Article 4, paragraph 5).
  6. Before your first market day, contact the market operator (a municipal utility company or another trader providing market services) and get the market rules. Under Article 82 they cover the rules of sale, type of goods, display, and upkeep of premises and equipment. Fees and conditions for using stalls are set by the operator, so ask them.

Where to go

  • The market operator and municipal administration in your town, for market rules, stall and fee.
  • Poreska uprava Republike Srpske (Tax Administration), to confirm whether your sales must be fiscalised.
  • Republička uprava za inspekcijske poslove (Republic Inspection Administration), market and sanitary inspection, for hygiene and quality requirements.

Laws and sources

The Regulation was amended in 2025 (Službeni glasnik RS nos. 6/25, 68/25 and 87/25). This article describes point 6 as amended in August 2025, when the words "directly to the final consumer" were deleted. The Regulation and all amendments are published on the Tax Administration website; confirm your own case with them.
